Rep. Joo Jin-woo, a former senior prosecutor and chairman of the People's Power Legal Advisory Committee, expressed doubts again about the acquittal of Lee Jae-myung, chairman of the Democratic Party of Korea, in the first trial of perjury teachers. As the ruling is unusual, his analysis is that the results will be reversed at the appeal trial.
Joo appeared on SBS radio's "Kim Tae-hyun's Political Show" on the 27th and pointed out that there was a "foul act in the trial" in Lee's first trial. He pointed out that "Representative Lee directly gave perjury over the phone, but the biggest part was sent a summary of his argument, and he also sent a witness interrogation to be asked by Representative Lee's lawyer on the day of his appearance."
"Originally, the defendant and the witness are not allowed to contact each other, and in fact, they don't even make eye contact when they go to the trial court," lawmaker Joo said. "If you allow this now and say it's not a perjury teacher, it doesn't fit the existing perjury teacher rulings."
"In a way, (this trial) has opened the door to hell for perjury teachers," he said. "If we allow this behavior from now on, it will have a huge negative impact on other courts as witnesses can meet with the accused before they go to court, eat, appear, read the summary of their arguments, and testify on the spot."
Regarding the "trial delay prevention task force" launched at the party level in connection with Lee's recent trial, Joo said, "When the perjury teacher case and the violation of the Public Official Election Act were sentenced this time, it took too long than usual in the first trial. In particular, he explained that the violation of the Public Official Election Act was sentenced in two years and two months.
"Of all the cases of violation of the Public Official Election Act that were problematic in the last presidential election, only this one has not been confirmed," he said. "So you can intuitively see how late it was."
"The second trial must come to a legal conclusion in three months. Not long ago, the Chief Justice of the Supreme Court also said that it is a principle and must be observed, so we should not allow this trial to be dragged out. "The same goes for perjury teachers. There are also transcripts, and in a way, it is the case with the most evidence among perjury teachers. I think the interpretation of this transcript and recording file is a little divided right now," he added.
Representative Joo, who was previously confident that representative Lee would be convicted in the first trial of perjury, pointed out on the 25th, the day of the sentencing, in a notice by the National Assembly's press corps, that it was a "judgment outside common sense." At the time, Representative Joo said, "I expect the judiciary to judge the case correctly, even if it is to correct legal justice and common sense."
